   eClarity health and ECscribe are not responsible for reporting charges/ payments between the hospital/ radiology centre and the radiologist; unless the studies are assigned to the radiologist directly by ECscribe with a written agreement for the same between ECscribe and radiologist.
2. Limited Liability :
   The teleradiology software is provided "as is" without any warranties or guarantees of any kind, whether expressed or implied. The software provider and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with the use or inability to use the software or related services.
3. Security and Privacy :
   While the software provider takes reasonable measures to ensure the security and privacy of transmitted data, no system can be guaranteed to be 100% secure. Users should understand the risks associated with transmitting sensitive medical information and take appropriate precautions.
4. Compliance :
   Users are responsible for complying with all applicable laws, regulations, and ethical guidelines when using the teleradiology software. It is the user's responsibility to ensure that they have the necessary licenses, permissions, and qualifications to perform radiological interpretations or consultations.
5. Technical Issues :
   The software provider does not guarantee uninterrupted or error-free operation of the teleradiology software. Users should understand that technical issues or system downtime may occur, and the provider will not be liable for any losses or damages resulting from such issues.
6. Changes to Software :
   The software provider reserves the right to make changes or updates to the teleradiology software, including its features, functionalities, and terms of use, without prior notice.
7. User Responsibilities :
   Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their accounts. Users should not share their login information with unauthorized individuals.
8. Indemnification :
   Users agree to indemnify and hold the software provider and its affiliates harmless from any claims, damages, liabilities, or expenses arising out of or in connection with the use of the teleradiology software or any violation of this disclaimer.
9. Non-Guarantee of Results :
   The Software provides assistance in the interpretation of medical images, but it cannot guarantee the accuracy, completeness, or reliability of the results. The final responsibility for diagnosis and treatment decisions rests with the healthcare professionals using the Software.
10. Third-Party Payment Processors :
    eClarity and ECscribe engages the services of third-party payment processors to facilitate payment transactions. The use of these processors is subject to their respective terms and conditions. eClarity or ECscribe is not responsible for any issues, errors, or disputes that may arise from the use of third-party payment processors.
11. Refunds and Cancellations :
    Refund policies and procedures for teleradiology services will be outlined in the payment agreement or invoice. Any requests for refunds or cancellations must be made in accordance with the specified terms and conditions.
12. Governing Law :
    This disclaimer and any disputes arising from payment transactions with eClarity or ECscribe shall be governed by and interpreted in accordance with the laws of Kerala, India. Any legal actions or proceedings related to payment matters shall be conducted in the courts of Trivandrum, Kerala, India.
13. Limitation of Liability :
    eClarity and ECscribe will not be liable for any damages, losses, or liabilities arising from payment transactions, including but not limited to unauthorized access to payment information or errors in payment processing, unless caused by our gross negligence or willful misconduct.
14. Payment Disputes :
    If you have concerns or disputes regarding billing or payment matters, you must notify eClarity and ECscribe promptly. We will make reasonable efforts to address and resolve any payment-related issues in a timely manner.
15. Accuracy of Payment Information :
    You are solely responsible for providing accurate and up-to-date payment information, including but not limited to credit card details or bank account information. eClarity and ECscribe will not be liable for any errors or delays in payment processing resulting from incorrect or outdated payment information.
